Town Manager Mike Segrest recently told the Town Council that the Town was unable to reach an agreement with the contractor that applied a rubber cape seal on Moraga Road about a year ago, and he has informed the company that the Town is formally rejecting its work. After the new surface started to fail, town staff tried to negotiate with the contractor to obtain a resurfacing, not a simple patching. According to Segrest, other municipalities of the Bay Area that contracted with the same company for the same road treatment have experienced the same failures. "We still want to give the contractor the opportunity to correct their work," said the Manager. The Town's Attorney, Michelle Kenyon, indicated that she would not recommend going after the contractor's bond (the agency that provided the financial assurance that he would do the work) because the process would be very lengthy.
